PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records of the proceeding 26.09.2025 dated notice issued by the 4th respondent in respect of survey number 178 (59.08.00 hectare) at Kallangadu, Karungalkudi Post, Vanchinagaram, Melur Taluk, Madurai District and quash the same and to pass appropriate orders to petitioners. ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) WMP (MD) No.25014 of 2025 filed seeking to file a single writ petition is ordered on payment of separate Court fee.
2. This writ petition is instituted based on certain errors in the impugned notice dated 26.09.2025. Infact, identical errors have been transpired in other notices as well and in WP(MD)No.30022 of 2025, we had recorded the submissions of the learned Additional Government Pleader, who appeared for the respondents withdrawing the notice. 2/5
3. Mr.S.P.Maharajan, learned Special Government Pleader, who appears for the respondents states the impugned notice will not be pursued and may be treated as withdrawn.
4. We record the same. That apart, under Board Standing Order 26(3), there is a stipulation that separate notices under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, should be served in respect of each occupant of the property. This aspect shall also be taken note of by the authorities while issuing notices afresh.
5. This writ petition stands disposed, in light of this order directing the authorities to issue separate notices in accordance with law forthwith. No costs. Connected miscellaneous petitions are closed. [A.S.M.J.,] & [C.K.J.,] 07.11.2025 NCC :Yes/No Index :Yes/No sm 3/5
