ORDER : The Court made the following order :- 1/4
The petitioner/Accused No.3, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 194 of BNSS @ Section 103 of BNS, 2023, in Crime No.367 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is the cousin brother of the deceased. A1 who is the husband of the petitioner was taken care of the deceased as his parents were no more and the deceased was mentally disordered person who had requested A1 to arrange marriage for him. For that A1 refused citing his mental condition for which the deceased scolded A1. Hence, A1 planned to administer poison to the deceased. The petitioner/A3 was holding the deceased head and the other accused A1 and A2 administered poison to the deceased and he died. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and she has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide 2/4
by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.
4. The learned Additional Public Prosecutor submitted that the specific overtact against the petitioner is she had holding the head of the deceased for administering poison by other accused. Hence, he opposed for grant of anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and the specific overtact against the petitioner is she had holding the head of the deceased for administering poison by other accused, and also considering the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 07.11.2025 PJL 3/4
