PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to issue fresh passport to the petitioner by processing petitioner's online application vide File No. MD1065360150225 dated 18.07.2025 by considering the petitioner's representation dated 03.09.2025 within the time frame as fixed by this Court. ORDER
The present writ petition has been filed seeking a mandamus directing the first respondent for issuance of the passport to the petitioner by considering his online application dated 18.07.2025 and his representation dated 13.09.2025.

The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.119 of 2015 on the file of the second respondent which has culminated in filing of a charge sheet on 15.08.2015 before the learned Judicial Magistrate No.II, Ramnad. Due to the memo of objections raised by the said Court, the charge sheet has not been taken on file. It has been refiled on 10.12.2025. So far, it has not been taken on file.

Considering the fact that as on today, the trial Court has not taken cognizance, there is no legal impediment for the first respondent to consider the request of the petitioner for issuance of the passport. The first respondent is directed to consider the request of the petitioner for issuance of the passport and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition stands disposed of. No costs.
