Respondents Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents 1 to 4 to remove the entire encroachment made by the 5th respondent in S.No.42 within Ottanchatiram Taluk limits and Ottanchatiram Municipal limits.

ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner has come up with this writ petition by way of public interest litigation seeking a direction to the respondents 1 to 4 to remove the alleged encroachments made on the land comprised in S.No.42 at Oddanchathiram Taluk, Dindigul District.

2.The learned Additional Government Pleader would submit that S.No.42 is a private land belongs to the 5th respondent and it is not a Government land.

3.When the matter is listed for hearing, neither the petitioner nor his counsel made his appearance. We accede to the stand taken by the learned Additional Government Pleader. Accordingly, the writ petition is dismissed. No costs.
