ORDER
The writ petition has been filed seeking direction to the respondent to consider the appeal filed by the petitioner dated 10.10.2025.
2. The learned counsel for the respondent would submit that no appeal has been filed by the workman/petitioner against the order of dismissal passed by the respondent.
3. The learned counsel for the petitioner relied upon the Service, Conduct, Discipline and Appeal Rules and also submitted that an appeal remedy is available under Rule 106.1.
4. On perusal of the standing order, would indicate that it is applicable only to employees as defined under O.108, who are not considered workmen under the Industrial Disputes Act, 1947. 2/4
5. In view of the above, the mandamus sought by the petitioner cannot be granted. It is for the petitioner to approach the appropriate authority under the Industrial Disputes Act, 1947. Accordingly, this writ petition is dismissed. No Costs.
