O R D E R

This Writ Petition has been filed for a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order dated 08.07.2025 passed in Na.Ka.No.3284/A1/2025 on the file of the second respondent and quash the same as illegal and consequently, direct the first respondent to number the petitioner's appeal dated 04.09.2024 and dispose of the same.

2. Even though the petitioner had challenged the endorsement made by the second respondent on the order of punishment imposed against him by the third respondent, he had also filed an appeal before the first respondent by his appeal dated 04.09.2024. 2/5

3. Since he had already filed an appeal, this Court is of the view that the appellate remedy, which is an efficacious remedy, opted for by the petitioner can be disposed of by the first respondent. In view of the same, there shall be a direction to the first respondent to take the appeal filed by the petitioner on 04.09.2024 as against the order of the punishment imposed by the third respondent dated 07.08.2024 on merits and in accordance with law and dispose of the same within four (4) months from the date of receipt of a copy of this order. If any stay application is filed by the petitioner, the same shall be entertained by the first respondent within two (2) weeks from the filing of such application.

4. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
