Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of certiorarified mandamus to call for the records pertaining to the impugned order passed by the 3rd respondent in C.No.A1(2)/52541/2012 dated 10.05.2013 and quash the same and consequently direct the Respondents No.2 & 3 to fix the seniority and give the notional promotion with monetary benefits to the petitioner.

The issue involved in the present writ petition is with regard to fixation of seniority in the cadres of Head Constable and Special Sub-Inspector of Police. The disputes in relation to the fixation of seniority amongst these two cadres are subsidized by the Honourable Division Bench of the Principal Bench of this Court as well the Honourable Supreme Court of India. The issues are to be adjudicated by the Apex Court for reaching finality in respect of the disputes raised. Under these circumstances, no purpose would be served in the event of keeping the present writ petition pending. https://hcservices.ecourts.gov.in/hcservices/

The claim of the writ petitioners can be considered based on the orders to be passed by the Apex Court as well as the Principal Bench of this Court. The benefits are to be regulated with the reference to the orders to be passed in this regard by the appropriate Court of law.

2. With these observations, the writ petition is disposed of. No costs.
