Po/ViNi/Kottar/Ko.Ka./Aa. En 582 dated 14.10.2025 passed by the 3rd Respondent and quash the same as illegal, and consequently direct the Respondents to shift the electricity meter box pertains to EB connection number 07-121-206-323 for the shop in Door No.261A, Cape Road, Kottar Post, Nagercoil, Kanyakumari District, within the time stipulated by this Court.

ORDER

This writ petition has been filed to quash the impugned order in Ka.En.E.Ni.Mi.Po/ViNi/Kottar/Ko.Ka./Aa. En 582 dated 14.10.2025 passed by the 3rd Respondent and consequential direction to the Respondents to shift the electricity meter box pertains to EB connection number 07-121-206-323 for the shop in Door No.261A, Cape Road, Kottar Post, Nagercoil, Kanyakumari District, within the time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and Mr.S.Deenadhayalan, learned Standing Counsel, who takes notice on behalf of the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that he is running a Tea Shop in the name and style of "Kundusahib Tea Kadai' at Door No.261A, Cape Road, Kottar, Nagercoil, Kanyakumari District, for which, she holds a valid license. The property, in which the said shop is situated, originally

belonged to the petitioner's late grandfather, Abdul Rasak. After his demise, the same came to be inherited by the petitioner's father, Mohaideen Abdul Kader, who thereafter rented it out to the petitioner. The electricity service connection to the said shop stands in the name of the petitioner's grandmother, Mymoon Marzliya, who has since passed away. As the position of the electricity meter box is in a dangerous condition, the petitioner sent a representation to the authority concerned to shift it to a safer alternate place. However, the third respondent passed the impugned order rejecting the petitioner's request citing the reason that the allottee of EB connection is no more. Aggrieved over the same, the petitioner is before this Court.

4. The learned Standing Counsel would submit that shifting of electricity meter box can take place only after the service connection has been transferred in the name of the petitioner herein.

5. The petitioner would submit that the legal heir of her grandmother, who was the original owner, has no objection for grant of electricity connection in her name.

6. In view of the above, the petitioner is directed to obtain No Objection from the legal heir of the original owner and submit No Objection letter, death certificate of the original owner as well as the legal heirship certificate and file an application for changing the name in respect of the service connection in her name along with the application for shifting of electricity meter box. On receipt of those applications along with necessary documents as stated above, the name of service connection shall be transferred in favour of the petitioner as well as the shifting of meter box shall take place, within a month, if the documents submitted are in order.

7. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 13.11.2025 NCC : Yes/No Index : Yes/No Rmk
