ORDER

This Civil Revision Petition is filed seeking a direction to the District Munsif Cum Judicial Magistrate Court, Papanasam to dispose the suit in O.S.No.40 of 2021 on the file of the District Munsif cum Judicial Magistrate Court, Papanasam.

2. The learned Counsel for the petitioner would contend that the sole plaintiff in the suit died on 09.12.2023 and even as of today no steps have been taken on the side of the plaintiff to bring on record the legal heirs of the deceased plaintiff.

3. Since the sole plaintiff is no more, the suit must necessarily stand abated. In view of the same, this Civil Revision Petition is disposed of with a liberty to the petitioner to take out necessary application, before the learned District Munsif cum Judicial Magistrate, Papanasam, seeking to dispose of the suit as abated. If such application is made by the petitioner herein, the same shall be considered the learned District Munsif cum Judicial Magistrate, Papanasam shall pass appropriate orders within a period of two weeks from the date of such application.

4. This Civil Revision Petition is disposed of with the above directions. No costs.
