PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARI to call for the records pertaining to the impugned order passed by the 1st Respondent in Na.Ka.A3/247/2020 dated 10.09.2025 and quash the same as illegal.

ORDER

An order dated 10.09.2025 of the revenue Divisional Officer, Sivagangai is challenged in this writ petition. In view of the existence of the alternative statutory remedy of revision before the District Revenue Officer, learned counsel for the petitioner submits that the petitioner be permitted to avail of such statutory remedy.

2. Learned Government Advocate accepts notice for respondents 1 and 2. He submits that an alternative statutory remedy is available.

3. In order to enable the issuance of an effective direction, the District Revenue Officer, Sivagangai District is suo motu impleaded as the 4th respondent herein. The order shall be issued after carrying out the correction in the writ petition.

4. By considering the submissions of learned counsel for the petitioner, without making any observations on the merits, this writ petition is disposed of 2/4

by granting leave to the petitioner to assail order dated 10.09.2025 by way of revision before the District Revenue Officer. If such revision petition is filed within 30 days from the date of receipt of a copy of this order, the District Revenue Officer is directed to receive and dispose of the same on merits without going into the question of limitation. The District Revenue Officer is further directed to dispose of the revision petition on merits within a period of three months from the date of such petition after providing a reasonable opportunity to the petitioner, the third respondent herein and any other party who would be affected by such decision. No costs. Consequently, connected writ miscellaneous petition is also closed.
