O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for respondents 1 to 3 and the learned Government Advocate appearing for the fourth respondent.

2. Issuance of notice to the private respondents is dispensed with.

3. The petitioner alleges that the temple is said to be illegally constructed in survey No.142 Nadumuthalaikulam. According to the writ petitioner, survey No.142 is a water body. 2/4

4. The learned Special Government Pleader on instructions states that while survey No.142 is very much a water body, the temple was constructed in survey No.144/19. He clarifies that the water body in question has not been encroached. He further clarifies that no construction will be allowed in survey No.142.

5. Recording the stand of the official respondents, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
