ORDER
The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Mandamus direct the respondent to consider the petitioners representation dated 14.10.2025 to correct the Birth Certificate of her minor son P.N.Praveen Kumar bearing Registration No.121/2012/08 dated 10.01.2012 issued by the Respondent by substituting the father name as S.Pitchai in the place Chinnapandi in the name of the father column, within the time stipulated by this Honble Court and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render justice."

The facts as set out in the affidavit filed in support of the writ petition reads as follows:- The petitioner would submit that she had married one Chinnapandi on 07.04.1994 and due to matrimonial dispute they parted ways. While so, on 20.03.2009, she was appointed to the post of Field Assistant in Tamil Nadu Electricity Board through the employment exchange. Thereafter, she was in a live-in-relationship with her colleague namely S.Pitchai and out of the cohabitation, a male child namely Praveen Kumar was born on 08.01.2012.

She would submit that at the time of delivery, her husband's name has been wrongly given by the petitioner's parents at the time of admission in the hospital and the same has been entered in the birth certificate. As a result of which, the birth certificate incorrectly records Chinnapandi's name as the father instead of S.Pitchai, who is the biological father. She would submit that in all the school records, the name of the child's father has been correctly entered as S.Pitchai.

She would further submit that her child has been qualified to participate in the 69th National School Games in Handball under -14 years Boys Championship 2025-2026, conducted by the School Games Federation of India. The said sports event is scheduled to be held between 05th January and 10th January 2026 in Rajasthan. In this connection, the child's birth certificate along with other certificates has to be submitted by the petitioner. However, the name of the child's father had been entered incorrectly on the birth certificate and therefore, she was advised to correct it.

5. That apart, she would submit that she had submitted a representation dated 14.10.2025, to the respondents requesting them to substitute the name of the biological father namely S.Pitchai in the birth certificate of the petitioner's child. However, the same has not been considered to date.
6. She would submit that in the mean time she had filed H.M.O.P.No.111 of 2014 on the file of the Principal Subordinate Court, Dindigul against her husband, Chinnapandi and the same was later dismissed as not processed on 23.06.2017. Subsequently, the said Chinnapandi has passed away on 23.05.2020.
7. Mr.J.Lawrence, learned Standing Counsel takes notice on behalf of the respondent would submit that the representation dated 14.10.2025 will be considered and orders will be passed within the time stipulated by this Court.

In view of the above without expressing any opinion on the merits of the matter, the respondent is directed to consider the representation of the petitioner dated 14.10.2025 and pass final orders on its own merits and in accordance with law, within a period of four (4)weeks from the date of receipt of a copy of this order.
9. With the above observations, the writ petition stands allowed. No costs.
