ORDER: The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 296(b),115(2),118

(1) & 351(3) of BNS, 2023 in Crime No.514 of 2025, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the Defacto Complainant's younger brother insisted the A-1 to buy liquor and the same was informed to the Defacto Complainant's father and they have beaten him. Since then, they have been enmity against them. On 19.10.2025 at about 08.30 P.M., while the Defacto Complainant was passing in front of the A-1's house, the accused persons way laid the Defacto Complainant and abused with filthy languages and attacked with wooden logs and caused blood injuries and also threatened with dire consequences. Thereafter, the Defacto Complainant was took to the Government Hospital, Kanavilakku, through 108 Ambulance for treatment and admitted as in-patient. Hence, a case has been registered as against the petitioners.

3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not 2/5

committed any offence. He seeks this Court to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioners are serious in nature. Further, the petitioners 1, 3, 4 and 6 were arrested and remanded and the petitioners 2 and 5 were not arrested.

5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence, the specific overt act against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. 10.11.2025 TMG 3/5
