ORDER
Seeking quashment of the impugned charge sheet in S.T.C.No. 622 of 2025 dated 28.10.2025 on the file of the learned Judicial Magistrate, Devakottai, this criminal original petition is filed. 2.The learned counsel for the petitioners submitted that all the petitioners herein are the Accused Nos.1 to 10 in S.T.C.No.622 of 2025 pending on the file of the learned Judicial Magistrate, Devakottai, arising out of Crime No.400 of 2025 for the offense under Section 287 of BNS.

3.The case of the prosecution is that on 17.10.2025 at about 21.00 hours, while the defacto complainant/ Sub Inspector of Police was present at the police station, the second petitioner, who is an Advocate, was arrested by the respondent police in connection with Crime No.4 of 2025 and later, based upon the order passed by this Court not to arrest the second petitioner, he was released, following which, the petitioners other than the second petitioner along with others gathered in front of the police station and had bursted crackers, for which, first information report in Crime No.400 of 2025 was registered, which culminated in laying a charge sheet in S.T.C.No.622 of 2025. 4.
On earlier occasion, when this matter was listed, the petitioners had voluntarily undertaken to file an affidavit expressing their regret for the unfortunate circumstances, under which, the alleged incident had occurred and also with the assurance that no such incident would ever occur in future. However, this Court had directed the petitioners to file a better affidavit. In this regard, Today (i.e., 05.02.
tone of expression of regrets and sought for the indulgence of this Court by quashing the final report by accepting the petitioners affidavit. 5.Per contra, the learned Additional Public Prosecutor strongly objected the same submitting that such kind of affidavit cannot be accepted and sought for dismissal of this case. 6.Considering the fact that among the petitioners, eight of them are Advocates and few of them are law students and one Advocate Clerk and also considering that all of them are below the age group of 40, accepting the affidavit filed by the petitioners, the final report in S.T.C. No.622 of 2025 is hereby quashed on condition that the petitioners shall contribute a sum of Rs.5000/- each for establishing an E-Library to the credit of the MBHAA, in Indian Bank, Madurai Bench of Madras High Court Branch, Account No.496038755 IFSC No.IDIB000H040, MICR Code: 625019020. Accordingly, this Criminal Original Petition is allowed. Consequently, connected Miscellaneous Petition is closed.
