C-33R. To set aside the order dated 29.10.2025 in Crl.M.P.No.515 of 2025 passed by the Learned Principal Special court for Exclusive Trail of Cases under POCSO, Theni district and to relax the conditions imposed in Crl.M.P.No.301 of 2025 dated 04.07.2025.

ORDER

The petitioner has filed a petition for relaxation before the Trial Court and the same has been dismissed through the impugned order. The reason cited in the impugned order is that petitioner would intimidate the victim.

2.However, the learned Counsel appearing for the petitioner submitted that he will undertake not to intimidate the victim.

3.The learned Government Advocate (Crl.side) submitted that the charge sheet was filed on 18.05.2025.

4.Considering the above said submissions, this Court is inclined to consider the present petition. Therefore, the impugned order is set aside and the condition is relaxed with the following conditions:

[a]The petitioner shall not intimidate the victim or their family. [b]The petitioner shall not enter the street of the victim's school, house and also where the victim is there.

[c]If the petitioner is violating any of the above said conditions, the bail granted to the petitioner shall automatically stand cancelled.
