ORDER

The writ petition has been filed seeking a direction to the respondent to provide the petitioner with suitable permanent alternative employment, with pay protection, continuity of service, and all other attendant benefits, along with wages from 24.06.2021 till the date of providing permanent alternative employment, in accordance with Section 20(4) of the Rights of Persons with Disabilities Act, 2016, after deducting the wages already paid to him during the periods in which he was provided work and wages.

2. The learned counsel for the petitioner would submit that the petitioner suddenly suffered a stroke. Hence, he repeatedly approached the respondent and requested that alternative employment be provided, taking note of his health condition. However, the same has not been considered by the respondent so far. Therefore, he has approached this Court.

3. The learned counsel for the respondent would submit that the petitioner was referred to the Medical Board and that a report regarding the petitioner's health condition has been received from the Medical Board.

Considering the above submissions, the respondent is directed to act upon the report of the Medical Board and provide the petitioner with alternative employment, with pay protection and all other attendant benefits, in terms of Section 20(4) of the Rights of Persons with Disabilities Act, 2016, and in the light of the judgment of the Honourable Supreme Court reported in (2018) 1 SCC 579. Such exercise shall be carried out by the respondent within a period of four weeks from the date of receipt of a copy of this order.
