ORDER

(Order of the Court was made by the Hon'ble G.K.ILANTHIRAIYAN J.) This Civil Miscellaneous Petition is filed to permit the petitioner to withdraw the deposited amount into the credit of M.C.O.P.No.361 of 2022, on the file of the Motor Accident Claims Tribunal (Principal Subordinate Judge), Karur.

2. Heard the learned counsel for the petitioner and the learned counsel for the first respondent.

3. This Court, by order, dated 20.06.2025, has granted conditional stay. As per the order of this Court, dated 20.06.2025, the Insurance Company has deposited the entire award amount along with proportionate accrued interest and costs to the credit of M.C.O.P.No.361 of 2022, on the file of the Motor Accident Claims Tribunal, Principal Sub-Court, Karur.

4. Considering the above facts and circumstances of the case, this Civil Miscellaneous Petition is allowed and the petitioner is permitted to withdraw 50% of the award amount along with proportionate accrued interest and costs, deposited by the first respondent/appellant to the credit of M.C.O.P.No.361 of 2022, on the file of the Motor Accident Claims Tribunal (Principal Subordinate Judge) Karur, as per the order of the Tribunal by filing proper application.
