ORDER

This Civil Revision Petition filed under section 115 of Civil Procedure Code, to set aside the fair and decreetal order dated, 07.08.2025 passed I.A.No.6 of 2024 in Unregistered A.S.No. of 2024 on the file of Learned Sub-Court Valliyoor.

2. Considering the fact that the appeal suit is still pending consideration, no prejudice would be caused to the respondents, if the 2/4

delay in representation is condoned. However, the petitioner who had been lethargic in not re-presenting the Court below, should be put on terms.

3. In view of the same, the impugned order is set aside and the delay of 846 days in representing the cross appeal is condoned, on condition that the petitioner pays a cost of Rs.5,000/- (Rupees Five Thousand only) to the District Legal Services Authority, Tirunelveli, on or before 28.11.2025.

4. With the above direction, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
