India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order in Na.Ka.C3/14830/2024 dated 16.09.2025 passed by the first respondent herein and set aside the same as illegal and consequently, direct the respondents 1 to 3 to restore the patta in S.No.320/3A and 320/3B of Kurundhani Vaariyanendhal Village, Kalaiyarkovil Taluk, Sivagangai District in its earlier position in accordance with law. O R D E R

An order dated 16.09.2025 of the District Revenue Officer is challenged in this Writ Petition.

2. Learned Additional Government Pleader accepts notice for respondents 1 to 3. He points out that the first petitioner's father challenged the same order in W.P.(MD) No.30778 of 2025. He also points out that the petitioners herein trace title through the grandmother of the first petitioner, Lourdu Mary. In the earlier Writ Petition, he submits that the first petitioner's father had also traced title to the same properties through his mother, Lourdu Mary.

3. On perusal of earlier order dated 31.10.2025 dismissing W.P. (MD) No.30778 of 2025, it is evident that the present Writ Petition relates to the same property. After extracting the relevant paragraphs of the impugned order, the following conclusion was recorded therein: "5. The above extracts reveal that the patta standing in the name of the petitioner and his family members was not disturbed with regard to lands classified as 'Ryotwari Punjai' whereas the patta has been cancelled with regard to lands classified as 'Arasu Poramboke' with the remark 'Kaipatrillathathu'. Parties have also been directed to approach the jurisdictional civil court in case of title disputes. I find no infirmity in the said order warranting interference under Article 226 of the Constitution."

4. The above conclusion applies with equal force to the case of the petitioners. Therefore, this Writ Petition is dismissed without any order as to costs. W.M.P.(MD) No.25318 of 2025 is allowed.
