Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF Mandamus directing the respondents to pay the petitioner interest at the rate of 18% per annum, the period of delay from 01.05.2024 to 24.08.2025 in paying the amounts paid towards his terminal/pension benefits namely EPF Employees Contribution, Gratuity, Encashment of leave and Commuted Value of Pension within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

ORDER

This writ petition has been filed for a writ of Mandamus directing the respondents to pay the petitioner interest at the rate of 18% per annum, the period of delay from 01.05.2024 to 24.08.2025 in paying the amounts paid towards his terminal/pension benefits namely EPF Employees Contribution, Gratuity, Encashment of leave and Commuted Value of Pension within a time frame and without affecting his right to claim balance amounts towards those benefits.

2. Considering the admitted fact that there has been a delay in payment, the petitioner is entitled to statutory interest as provided under law.

3. In view of the same, the writ petition stands disposed of. The respondents are directed to pay interest at the rate of 6% per annum on the belated terminal benefits payable to the petitioner from the date of his entitlement till the date of his payment within a period of 12 weeks from the date of receipt of a copy of this order.
