PRAYER: Civil Revision Petition filed under Article 227 of The Constitution of India to set aside the order dated 20.09.2025 to return the plaint in unnumbered O.S.No. SR 2215 of 2025 on the file of the learned Principal District Munsif Court, Vedasanthur and direct the learned Principal District Munsif Court, Vedasanthur to number the same by allowing this Civil Revision Petition and pass orders in accordance with law and thus render justice.

ORDER

This Civil Revision Petition is filed seeking to set aside the order dated 20.09.2025 to return the plaint in unnumbered O.S.No. SR 2215 of 2025 on the file of the learned Principal District Munsif Court, Vedasanthur and direct the learned Principal District Munsif Court, Vedasanthur to number the same.

2. The rejection of the suit by the court below was based on the finding that the petitioners had impleaded the defendants without any pleadings or relief claimed against them. Without complying with the said return, the petitioners/plaintiffs have filed the present Civil Revision Petition challenging the return endorsed by the court below. 2/4

3. In view of the above, this Court is of the opinion that it is for the petitioners to explain before the court below how the defendants are necessary parties to the suit. If such an endorsement is made, the court will be able to understand the necessity of impleading the defendants as necessary parties in the civil suit. Without doing so, the petitioners have filed the present Civil Revision Petition.

4. In view of the above, the present Civil Revision Petition is dismissed, with liberty to the petitioners to comply with the return made by the court below. If the petitioners comply with the return, the court below shall consider the same and proceed further in accordance with law.
