Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the second respondent to survey the land and to place the survey stones in Survey No.429/27, to an extent of 0-11.00 ares, situated at Kuzhipirai Village, Thirumayam Taluk, Pudukottai District based on the petitioner representations dated 22.09.2025 within a stipulated time fixed by this Court.

By relying on an Assignment Order issued in the year 2000 and patta No.1148, the petitioner had applied for a survey of land in survey No.429/27 ad measuring 1 are. The present Writ Petition relates thereto.

Learned counsel for the petitioner submits that the petitioner's possession was sought to be disturbed by one Singammal and Shanti and that the petitioner filed O.S.No.83 of 2012 against the said persons and obtained a judgment and decree dated 31.10.2013. He also submits that no appeal has been lodged against the said judgment and decree till date. Therefore, he submits that there is no rival title claim as on date.

3. Learned Government Advocate accepts notice for both the respondents. He submits that the petitioner's request would be acted upon after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them.

4. The petitioner has filed the assignment order and patta in his name. A copy of judgement and decree dated 31.10.2013 has also been 2/4

filed. In these circumstances, a case is made out to initiate action on the petitioner's application.

5. Accordingly, this Writ Petition is disposed of by directing the respondents to initiate action on the petitioner's application for a survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
