PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus forbearing the Respondents 1 to 4 from removing the petitioner from the Post of Panchayat Secretary at Puliyadithambam Village, Panchayat, Kalaiyarkovil Panchayat Union, Sivagangai District not otherwise than due process of law.

ORDER

This Writ Petition has been filed praying for a Mandamus, forbearing the Respondents 1 to 4 from removing the petitioner from the Post of Panchayat Secretary at Puliyadithambam Village, Panchayat, Kalaiyarkovil Panchayat Union, Sivagangai District not otherwise than due process of law.

2. Such an innocuous writ petition cannot be entertained, as the respondents have the authority under the provisions of the Tamil Nadu Panchayat Service Rules, 2023, to proceed in respect of any delinquency. 2/4

3. In view of the above, the writ petition is dismissed. However, if any action is sought to be initiated against the petitioner, the same shall be only made under the said provision. No Costs. Consequently, connected miscellaneous petition is closed.
