BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED :13.11.2025
CORAM:
THE HONOURABLE MR JUSTICE SENTHILKUMAR RAMAMOORTHY Balaiyah ... Petitioner Vs
1. The District Collector, Thanjavur District, Thanjavur.
2. The District Revenue Officer, Thanjavur District, Thanjavur.
3. The Revenue Divisional Officer, Thanjavur, Thanjavur District.
4. The Tahsildar, Thanjavur Taluk, Thanjavur District.
... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the Respondents No.1 and 2 to give necessary direction to the third respondent to reopen the proceedings in Na.Ka.2839/2023/A5 dated 31.03.2023, by granting the Patta to the Petitioner in connection with property comprised in Survey No. 171/14 to an extent of 5009 sq. ft situated at Mariyamman Kovil Village, Pinnainallur Circle, Thanjavur Taluk, Thanjavur District, based on the Petitioner's representation dated 1/4
20.05.2025 and 21.07.2025 within the time bound fixed by this Court. For Petitioner : Mr. G.Mathavan For Respondents : Mr.B.Saravanan Additional Government Pleader
O R D E R
By relying on a sale deed dated 25.01.2012 and a judgment and decree dated 04.04.2017 in O.S.No.162 of 2015 as also a judgment and decree dated 07.06.2013 in O.S.No.164 of 2010, the petitioner had applied for mutation of patta. The present Writ Petition relates thereto.
2. Learned Additional Government Pleader accepts notice for all the respondents. He submits that the matter is pending consideration of the Revenue Divisional Officer. He submits further that orders would be issued on merits after providing a reasonable opportunity to the parties concerned.
3. On perusal of the sale deed dated 25.01.2012, it appears that the petitioner has purchased the property from one P.Sami Ammal. Learned 2/4
counsel for the petitioner states that the patta currently stands in her name under patta No.647. In the absence of a copy of the patta, it is unclear as to whether the total extent in the relevant survey number was conveyed to the petitioner. Therefore, it is necessary to issue notice to the pattadar before a decision is taken.
4. Subject to the above observations, this Writ Petition is disposed of by directing the third respondent to consider and dispose of the petitioner's representations dated 20.05.2025 and 21.07.2025 within three
(3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the current pattadar. No costs.
