COMMON JUDGMENT Both the appeals are filed by one Shanmuganathan, who is the tenant of one Beeman. The landlord was said to have sold the property in favour of one Perumbadaiyar. With regard to the tenancy, there was a dispute between the parties and therefore, cases and counter cases were registered. The appellant Shanmuganathan failed to appear before the trial Court in S.C.No.105 of 2022 pending on the file of the II Additional Sessions Court, Tirunelveli. Therefore, a Non-bailable warrant was issued against him, pursuant to which, he was arrested by the respondent Police. Therefore, he moved a bail petition before the trial Court in Crl.M.P.No.132 of 2026 and the same was dismissed by the trial Court, by its order dated 07.03.2026. Challenging the same, he moved an appeal before this Court in Crl.A.(MD)No.335 of 2026.
2. One Perumbadaiyar, who is the private respondent in both the appeals, has lodged a private complaint as against the appellant Shanmuganathan and one Dr.Nangaiappan, who is the second appellant 3/8
in Crl.A.(MD)No.1325 of 2025, before the II Additional District and Sessions Court (PCR) Tirunelveli and the same was taken cognizance, by order dated 25.10.2025, in RCS No.2 of 2025. As against the same, the appellant Shanmuganathan and Nangaiappan have filed another appeal before this Court in Crl.A.(MD)No.1325 of 2025.
3. Since both the appeals are related to the same parties, both the appeals are taken up together and disposed of by this common judgment.
4. Considering the dispute which arose out of the tenancy, this Court suggested the learned counsel on either side to solve the issue amicably. The learned counsel have agreed for the same. Therefore, this Court, by order dated 02.03.2026, referred the appeal in Crl.A.(MD)No. 1325 of 2025, to the Mediation Centre, by appointing learned counsel Mr.Krishnadoss, who is having 30 years of experience, as a Mediator and also granted interim bail to the appellant Shanmuganathan in Crl.A. (MD)No.335 of 2026, by order dated 16.03.2026 and referred that appeal also to the Mediation Centre.

On the best efforts taken by the Mediator and the co-operation extended by the learned counsel for the appellants and the second respondent, today, it is reported that the issue has been amicably settled between the parties. A joint compromise memo dated 13.04.2026 has also been filed before this Court, which was signed by the parties and also attested by their respective counsels.
6. The learned counsel for the second respondent submits that the second respondent would co-operate for quashing the proceedings pending against the appellant/s in S.C.No.117 of 2025 and S.C.No.105 of 2022 on the file of the II Additional District and Sessions Court (PCR), Tirunelveli.
7. In view of the above, both the Criminal Appeals are allowed. The joint compromise memo dated 13.04.2026 shall form part of the order. The Judgment dated 07.03.2026 made in Crl.M.P.No.132 of 2026 in S.C.No.105 of 2022 on the file of the II Additional Sessions Court, Tirunelveli is set aside. The Judgment dated 25.10.2025 in R.C.S.No.2 of 2025 on the file of the learned II Additional District and Sessions 5/8
Court (PCR), Tirunelveli, is also set aside. The appellant in Crl.A. (MD)No.335 of 2026 is ordered to be set at liberty in S.C.No.105 of 2022 on his own bond. The appellant/s shall workout his/their remedy by filing separate application to quash the proceedings in S.C.No.117 of 2025 and S.C.No.105 of 2022 pending on the file of the II Additional District and Sessions Court (PCR), Tirunelveli, before the appropriate Court. Consequently, connected miscellaneous petitions are closed.
8. This Court places its appreciation to the learned counsel on either side for the efforts taken and for solving the issue amicably between the parties.
