The petitioner asserts that he is the owner of 14 cents in survey No.417, which has now been subdivided as T.S.No.10/1A1A in Coolly Ghat Road, Kodaikanal. It is stated that the said extent of 14 cents is a part of the larger extent of 3.21 acres.

2. Learned counsel for the petitioner submits that the Tahsildar had earlier demarcated the extent of one P.Baktha Gowri and others pursuant to the order dated 16.03.2022 in W.P.(MD) No.4623 of 2022. Since such demarcation was done without notice to the petitioner, the petitioner carried the matter in appeal before the Revenue Divisional Officer. Learned counsel points out that the Revenue Divisional Officer set aside the order of the Tahsildar by an order dated 16.09.2024 and remitted the matter to the Tahsildar for reconsideration. Learned counsel submits that the present Writ Petition has been filed because the Tahsildar has not concluded the inquiry and issued orders upon remand.

3. Learned Special Government Pleader accepts notice for both the 2/4

respondents. He submits that the Tahsildar would pass orders on merits within three (3) months after providing a reasonable opportunity to all concerned.

In these circumstances, without expressing any opinion on the merits, this Writ Petition is disposed of by directing the Tahsildar to conclude the inquiry and pass orders on merits within three (3) months from the date of receipt of a copy of this order after complying with directions issued by the Revenue Divisional Officer in order dated 16.09.2024. In course of inquiry, it is needless to say that a reasonable opportunity should be provided to all parties who would be affected by such order. No costs.
