ORDER

Today, this case is listed under the caption "for being mentioned", at the instance of the learned Counsel for the petitioner.

2. In view of the submission made, Paragraph No.3 and 6 of the order dated 16.12.2025, is modified and the same is to be read as follows:- "3.Petitioner married the respondent on 07.11.2016. Out of wedlock, a child was born. Due to differences, parties have separated. Petitioner/husband initiated proceedings in G.W.O.P.No.464 of 2025 which is presently pending before Family Court, Padmanabhapuram. Pleading that husband is residing in Nagercoil and unable to travel from Nagercoil to Padmanabhapuram, he has moved this transfer petition.

6. Family Court may not insist upon the physical presence of wife on all hearing dates and permit to appear through Video Conferencing. For non-essential and procedural hearings, she may be permitted to be represented through a counsel. She shall, however, present herself before the Court, when Trial Court passes a specific order for her appearance or when his presence is indispensable."

3. Registry is directed to incorporate the above correction in the order dated 16.12.2025 in TR.CMP.(MD)No.630 of 2025 and issue fresh order copy to the respective parties.

4. The other portions of the order dated 16.12.2025 in TR.CMP.(MD)No.630 of 2025 shall remain unaltered/intact. 30.01.2026 rgm 3/4
