O R D E R

The petitioner traces title from one Bhuvaneshwari, who had settled the relevant properties in favour of her daughter, Maheshwari, who, in turn, was the petitioner's vendor.

2. After adverting to the settlement deed and sale deed, learned counsel for the petitioner invited my attention to the patta transfer order. He points out that such order contains a patent error inasmuch as it is recorded therein that the pattadar prior to the patta transfer is Chandrasekhar and the pattadar after patta transfer is Maheshwari.

3. Learned Special Government Pleader accepts notice for all the respondents. He has submitted the revenue records in relation to the property, indicating that the pattadar, as per the said records, is a temple.

4. The order impugned herein cannot be sustained inasmuch as it is 2/4

completely contrary to the documents submitted by the petitioner. On account of such patent error, the said order is set aside and the matter is remanded for reconsideration. After providing a reasonable opportunity to the petitioner and the pattadar as per revenue records, a speaking order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs.
