ORDER

Heard both sides.

2.The order is appealable under Section 10 of the Land Encroachment Act, 1905. The petitioner undertakes to file such an appeal within 30 days. If such an appeal is filed within time as undertaken before us, the order impugned in this writ petition shall not be enforced till the disposal of the appeal. The appellate authority shall number the appeal immediately on its filing and endeavour to dispose of it within a period of three months thereafter. If the petitioner fails to file an appeal as undertaken before us, the benefit of this order will stand recalled immediately. We make it clear that we have not gone into the merits of the matter.
