ORDER

The above petition has been filed seeking modification of the condition imposed in Crl.R.C.(MD)No.324 of 2025 dated 14.03.2025, wherein, this Court directed the petitioner to deposit original Registration Certificate in respect of the vehicle bearing Registration No.TN-76-BA-4611 before the learned District Munsif cum Judicial Magistrate, Shenkottai.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the first respondent police.

The learned counsel appearing for the petitioner would submit that fitness certificate for the said vehicle got expired on 02.11.2025 and for renewing the fitness certificate, the submission of original Registration Certificate is mandatory and that therefore, the petitioner may be given temporary custody of the original Registration Certificate only for the purpose of getting fitness certificate. 2/3

Considering the submission made by the learned counsel appearing for the petitioner, the learned District Munsif cum Judicial Magistrate, Shenkottai, is directed to return the original Registration Certificate of the vehicle bearing Registration No.TN-76-BA-4611 to the petitioner for the purpose of getting fitness certificate. The petitioner is directed to submit the original Registration Certificate within a period of fifteen (15) days from the date on which the same is received from the concerned Court.

5. With the above directions, this Criminal Miscellaneous Petition is disposed of. 25-11-2025 CSM To 1.The District Munsif cum Judicial Magistrate, Shenkottai.
