ORDER
This civil revision petition has been filed to direct the Subordinate Court, Aruppukottai, to expeditiously hear the proceedings in OS.No.85 of 2019 on the file of the Subordinate Court Aruppukottai, within a time frame stipulated by this Court.
2.This Court, vide order dated 09.02.2026, had directed the learned Subordinate Judge, Aruppukottai, to send a year wise pendency report of the pending suits and in compliance of the same, the learned Subordinate Judge, Aruppukottai, had sent a report vide proceedings D.No.145/2026, dated 16.02.2026, annexing the breakup details with regard to the pendency of the cases arising from the year 2003 to 2026, which was addressed to the Registrar (Judicial) of this Court. From the perusal of the same, it is seen that the total number of pending cases is 1189 and the pendency of the cases in the year 2019 is 43. The learned Subordinate Judge, Aruppukottai further submitted that connected suit in O.S.No.330 of 2025 is also pending before him. The learned counsel for the petitioner seeks joint trial of both suit, since the issue is one and the same and the parties are one and the same. The trial court shall consider the request made by the counsel for the petitioner for joint trial. 2/4
3.Since the present case is of the year 2019, the learned Subordinate Judge, Aruppukottai, is directed to expedite the trial and dispose of the case in O.S.No.85 of 2019 on merits and in accordance with law, along with the connected suit, as expeditiously as possible, preferably within a period of one year from the date of receipt of a copy of this order. If the trial court could not complete the same within a period of one year, liberty is granted to seek extension of time.
4.With the aforesaid directions, the Civil Revision Petition stands disposed of. No costs.
