PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 4 to pay the compensation to the Septic Tank illegally put by the fifth respondent adjacent to the petitioner's drinking water well.

O R D E R

This Writ Petition has been filed seeking to direct the respondents 1 to 4 to pay the compensation to the Septic Tank illegally put by the fifth respondent adjacent to the petitioner's drinking water well.

2.Learned Counsel for the petitioner would submit that the fifth respondent has constructed a septic tank very close to the drinking water well belonging to the petitioner and that the petitioner has preferred several complaints before the official respondents herein. However, so far, no action has been initiated by 2/6

any of the official respondents herein. Hence, the petitioner has preferred the present Writ Petition claiming compensation from the official respondents.

3.Learned Special Government Pleader appearing for the official respondents 1 to 3 would submit that the subject issue is purely a private dispute and that the official respondents are no way connected to the same. Hence, he prays for dismissal of this Writ Petition.

4.Heard the learned Counsel on either side.

5.Admittedly, the fifth respondent has constructed a septic tank in his patta land which is nearer to the drinking water well of the petitioner. Certainly, the fifth respondent is entitled to construct the septic tank within his patta land. In case, if there are any discrepancies or illegalities, the same cannot be adjudicated before this Court, since disputed questions of facts are involved. The petitioner can only approach the Civil Court for redressal of his grievance. Hence, this Court is not inclined to entertain this Writ Petition.

6.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
