Respondent Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in Na.Ka.No.1/2012 dated 12.02.2013 and passed by the respondent herein and quash the same as illegal and consequently direct the respondent to forthwith permit the petitioner to allow his duties as Headmaster of the respondent's school with all attendant benefits.

ORDER

When the matter came up for hearing, learned counsel for the respondent produced a memo signed by the respondent, namely, the Secretary, Ramanathan Chettiar Higher Secondary School, Nachandupatti, Pudukkottai District stating that the management is inclined to withdraw the order impugned in this writ petition reserving its liberty to conduct enquiry after complying with the statutory requirements.

2.In view of the above, the relief sought for in this writ petition has become infructuous. Accordingly, the writ petition is dismissed as infructuous. The said memo shall form part of the records. It is open to the management to conduct proper enquiry and pass appropriate orders. No costs. Consequently, M.P.(MD).Nos.1 and 2 of 2013 are closed.
