PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to issue patta in the name of the petitioner for the property comprised in Survey No.188/1A2 situated at Nallamanarkottai Village, Vedasanthoor Taluk, Dindigul District based on the online application dated 10.09.2025 submitted by the petitioner. ORDER

By relying on sale deed dated 16.07.2025 and the patta in the name of Chinna Veera Goundar, the petitioner had applied for mutation of the patta in relation to S.No.188/1A2. The present writ petition relates thereto.

2. Learned counsel for the petitioner referred to the sale deed and other documents annexed to the deed to contend that the patta transfer has not been effected in spite of the lapse of more than three months since the date of purchase of the property.

3. Learned Special Government Pleader accepts notice for the sole respondent. He submits that the inquiry would be concluded and orders would be issued on merits within six weeks from the date of receipt of a copy of this order.

4. The sale deed reveals that the petitioner purchased the property from three legal heirs of the pattadhar. In these circumstances, it is necessary to identify all the legal heirs and issue notice to them before concluding the enquiry.

Accordingly, this writ petition is disposed of by directing the Tahsildar to proceed with and conclude the inquiry in relation to the petitioner's request for patta transfer after providing a reasonable opportunity to the petitioner and all the legal heirs of the pattadhar. A speaking order shall be issued within six weeks from the date of receipt of a copy of this order. In course of enquiry, the Tashildar is directed to provide copies of documents to the rival parties. No costs.
