ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the appeal preferred by the petitioner under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, on 18.10.2023, and his representations dated 20.11.2023 and 29.01.2024, within a time to be fixed by this Court.
2. Mr.A.Kannan, learned Additional Government Pleader, takes notice for respondents 1 and 2. Since no adverse order is going to be passed against the third respondent, notice to him is dispensed with. By consent, the writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner, a senior citizen, executed a Settlement Deed on 09.06.2021 in favour of his son, the third respondent, with the expectation that he would be maintained in his old age. However, soon after the execution of the deed, the third respondent allegedly neglected and failed to support him. Hence, the petitioner filed a complaint on 20.09.2022 before the Revenue Divisional Officer under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. He also filed a civil suit seeking to restrain the third respondent from alienating the property, which 2/5
was partly decreed in his favour on 07.10.2025. An order was passed by the second respondent on 18.08.2023. Aggrieved by it, the petitioner preferred a statutory appeal to the first respondent/District Collector on 18.10.2023. However, till date no final order has been passed. Hence, he filed the present writ petition.
4. The learned Additional Government Pleader appearing for respondents 1 and 2 submits that the petitioner's appeal will be considered and disposed of in accordance with law.
5. In view of the above, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the petitioner's appeal dated 18.10.2023 and pass final orders on its own merits, after affording reasonable opportunity to the petitioner and the third respondent, within a period of one month from the date of receipt of a copy of this order.
