Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records from the file of the 2nd respondent in Na.Ka.No.16326/24/A1/Thu.Kudi dated 08.01.2025 and quash the same as illegal and consequently direct the respondents 1 to 6 to prepare the voters list and conduct the fresh election by following due procedure in fair and proper manner within the time fixed by this Court. ORDER

Heard the learned counsel for the writ petitioner and the learned standing counsel for the respondents 1 to 5. Issuance of notice to the respondents 6 to 17 is dispensed with.

2.The petitioner challenges the proceedings of the Board whereby approval was granted for the newly elected executive committee of the petition mentioned waqf.

3.Such challenges have to be mounted only before the Waqf Tribunal by filing OA. If the petitioner files any such OA within a period of three weeks from the date of receipt of a copy of this order, it shall be numbered immediately without reference to limitation provided the papers are in order. The petitioner is also permitted to seek interim relief. The Tribunal will endeavour to effect service on all the contesting respondents as expeditiously as possible. In any event, the prayer for interim relief shall be disposed of within a period of eight weeks after it is filed. If the petitioner makes out a prima facie case, nothing stops the Tribunal from granting ex parte interim relief also. 4.With the aforesaid liberty to the petitioner to move the Waqf Tribunal, this writ petition is disposed of.
