PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to issue passport to the petitioner on the basis of his application dated 16.09.2025 pending in File No.MD1067945005314 before the 1st respondent by accepting his explanation within a time frame.

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent to issue the passport to the petitioner based upon his application dated 16.09.2025.

The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been chargesheeted in C.C.No.326 of 2022 on the file of the Judicial Magistrate No.I, Virudhunagar and it is pending trial. He also submits that the petitioner has been implicated in another criminal case on the file of the second respondent in Cr.No.117 of 2022 and charge sheet has been laid on 02.03.2023. The said charge sheet has not yet been taken on file.

The learned Government Advocate(crl.side) appearing for the third respondent submits that the petitioner has been implicated in a criminal case in Cr.No.1329 of 2016 and a charge sheet has been laid before the learned Judicial Magistrate No.VI, Madurai, on 27.08.2016. However, the charge sheet has not been taken on file and due to certain defects, it has been returned.

In view of the above said facts, the petitioner is directed to approach the learned Judicial Magistrate No.I, Virudhunagar, seeking the permission of the Court to go abroad by filing an application in C.C.No.326 of 2022. In case, any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the order to be passed by the concerned trial Court, the first respondent is directed to proceed in accordance with law.

5. With the above said observations, this writ petition stands disposed of. No costs.
