PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire record pertaining to the impugned communication of the 1st respondent in Letter Ref.No.SCN/1050692753/25 dated 09.10.2025 pertaining to the petitioner's Passport Application File No.MD6065698931825, quash the same as illegal, arbitrary and unsustainable and consequently direct the first respondent to process and issue the passport in the name of the petitioner without any further delay.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the request of the petitioner for issuance of passport has been rejected primarily on the ground that a criminal case is pending as against him.

A perusal of the records clearly reveal that the wife of the petitioner has lodged a police complaint as against the petitioner in Cr.No.71 of 2014 on the file of the All Women Police Station, Selayur, which has culminated in filing of the charge sheet in C.C.No.661 of 2025 and the same has been taken on file by the learned Judicial Magistrate No.II, Tambaram.

3. In view of filing of the charge sheet, the petitioner is at liberty to approach the trial Court concerned seeking the prior permission of the Court to go abroad. Based upon the orders passed by the concerned magistrate Court, the first respondent is directed to reconsider the issuance of passport. 2/4
