Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondent to grant pension to the petitioner with all arrears from the date of retirement. ORDER

The writ petitioner joined as a Teacher in the service of the Madurai Corporation and served about 20 years. However, the writ petitioner herself admits that she submitted a letter of resignation to the respondent on 04.06.1984 and the said resignation letter was accepted by the respondent and the writ petitioner was relieved from service on 08.08.1984. The acceptance of the resignation letter is enclosed in page No.1 of the typed set of papers filed along with this Writ Petition. 2.Once the resignation letter is accepted by the competent authorities, then the employee is not entitled for pension under the Tamil Nadu Pension Rules. The resignation amounts to forfeiture of pension as well as the past service rendered by the employee.

3.This being the rules in force, the writ petitioner is not entitled for pension as applicable under the Tamil Nadu Pension Rules in force. Accordingly, this Writ Petition stands dismissed. No costs.
