The above petitions have been filed (i) to condone the delay of 28 days in filing the petition to set aside the abatement caused due to the death of the first appellant (ii) to set aside the abatement caused due to the death of the first appellant and (iii) to bring on record the petitioners 2 to 5 legal representatives of the deceased first appellant and rank them as proposed appellants 2 to 5 in the above second appeal.
2.Heard the learned counsel for the petitioners and the learned counsel for the third respondent.
3.The learned counsel appearing for the third respondent would submit that they are having objections to condone the delay. But they have not specified any objections.
4.Records perused. Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are ordered and the Registry is directed to carry out necessary amendment in the second appeal and list the matter on 19.01.2026.
