2.Mr.H.Arumugam, learned counsel for the respondent has no serious objection for allowing this application.

3.Being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this Court is inclined to condone the delay of 115 days.

4.Accordingly, this Civil Miscellaneous Petition is allowed and the delay is condoned.
