Heard both sides.

2. The petitioner wants scheme to be framed for the petition-mentioned temple. It appears that O.A.No.5 of 2000 was earlier filed for the very purpose. The OA was dismissed for default. The petitioner seeks restoration of the same.

3. Instead of seeking restoration, the petitioner can as well file fresh OA and the same shall be numbered by the first respondent without reference to the dismissal of the earlier OA for default. This writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
