PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS, directing the 3rd Respondent to survey the land and fixed four boundaries by the 2nd Respondent in S.No.455/2A in Patta No.1463, to an extent of 7 cents situated in Sinthalavadi Village, Krishnarayapuram Taluk, Karur District on the basis of the petitioner's representation dated 22.08.2025.

ORDER

By relying on sale deed dated 21.08.2002 and patta No.1463, the petitioner applied for a survey of land in S.No.455/2A of the extent of 3 ares. The present writ petition relates thereto.

2. Learned Additional Government Pleader accepts notice for the respondents 1 to 3. He submits that action would be taken on the petitioner's application after issuing notice to owners of relevant adjacent lands, including the 4th respondent. He also states that any objections would be considered before deciding on the request for survey.

3. In view of the above submissions of learned Additional Government Pleader, it is unnecessary to issue notice to the 4th respondent in this writ petition. Instead, this writ petition is disposed of by directing the second respondent to conduct an inquiry in relation to the petitioner's request for survey after issuing notice to owners of relevant adjacent lands, including the 4th respondent. Objections, if any, from the said person shall be taken into account before a decision is taken. For the avoidance of doubt, it is clarified that the 2/4

survey should not be undertaken if there is a credible title dispute, whereas boundary disputes may be decided by the Tahsildar and Surveyor. A speaking order shall be issued within three months from the date of receipt of a copy of this order. No costs.
