ORDER : The Court made the following order :- 1/4
The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 351(2) of BNS, 2023 r/w. Sections 5(l), 5(o), and 6 of POCSO Act, 2019, in Crime No.211 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant's sister's son is studying in Ranji Aron Higher Secondary School and he is staying in Arasinar Students Hostel. When the defacto complainant and his sister went to the hostel to see her son/victim, he walked differently and unable to move properly, at that time, the defacto complainant questioned about it and he came to know that the hostel watchman/petitioner herein had committed sexual assault upon the victim. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks 2/4
bail for the petitioner.
4. The learned Additional Public Prosecutor produced the 164 statement of the victim boy, and he opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and the nature of offence and after reading the 164 statement of the victim, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
