ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 and 2 to survey and demarcate and fixing boundary stones in the petitioner's properties comprised in Survey Nos.96/1A3B & 96/1A2B2, Patta No.417, situated at Neiveli Thenpathi Village, Thiruvonam Taluk, Thanjavur District, as per the order made in W.P.(MD)No.15313 of 2024, dated 10.07.2024, passed by this Court, within the time frame that may be fixed by this Court.

2. Heard the learned counsel appearing for the parties.

3. The learned counsel appearing for the petitioner would submit that the petitioner has made a representation dated 20.08.2024 to the first respondent for demarcation of the boundaries of the property in question and the same is still pending without any progress.

4. The learned Additional Government Pleader appearing for the respondents would submit that after consideration of the claims, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

5. Recording the aforesaid submission, this Court directs the first respondent to consider the representation of the petitioner dated 20.08.2024 and demarcate the land of the petitioner, after consideration of the claims of both the parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
