ORDER
The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 4th respondent to provide reconnection in respect of Electricity Service Nos. 05-503-002-733 and 05-503-002-734 to petitioners premises comprised in Door No. 6 and 6/1, Kamatchi Amman Street, Palanichettipatti, Theni District based on the petitioner's representation dated 05.09.2025."
2. Mr.S.Deenadhayalan, learned Standing Counsel takes notice on behalf of the respondents 1 to 4.
3. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.

The petitioner would submit that originally electricity service connection in respect of the residential premises at Kamatchi Amman Street, Palanichettipatti, Theni District which was obtained in the name of his sister namely Deepalakshmi was subsequently transferred in his name by following due procedure.

He would submit that on account of the reconstruction/alteration works in the said house, he had surrendered the electricity service connection and availed a temporary service to facilitate the construction activity. On completion of the reconstruction/alteration, when the petitioner had applied for re-connection of earlier service, it was rejected on the ground of there being insufficient line clearance for the overhead transmission.
6. He would submit that this is factually incorrect. The actual clearance was for about 7 metres which exceeded the statutory minimum requirement 3.7 as per Regulation 60(1)(a) of the Central Electricity Authority (Measures Relating to Safety and Electric Supply) Regulations, 2010.

7. He would further submit that despite a detailed representation being given on 05.09.2025, the 4th respondent has not moved to consider the same.
8. The learned Standing Counsel appearing for the respondent Board would submit that the new construction which has been put up comes right below the over head line.
9. The learned counsel appearing for the petitioner on instructions would submit that the petitioner is ready to file an affidavit that he will not obtain any electricity service connection for the newly extended portion of the house.
10. In view of the same, the writ petition stands disposed of. The petitioner is directed to file an affidavit before the respondents and if the respondents being convinced that there is no electric line running in the room and further, if the representation made by the petitioner is within the rules, the same will be considered and orders will be passed within a period of eight (8) weeks from the date of receipt of a copy of this order. 4/6
11. With the above directions, the writ petition stands disposed of. No costs.
