ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 11.08.2025 for the offences punishable under Sections 310(2), 333, 127(7), 311, 351(3) and 332(b) of the Bharatiya Nyaya Sanhita (BNS), 2023. Subsequently the sections were altered into 310(2), 325, 61(2), 127(7), 311, 351(3), and 332(b) of the Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No. 244 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 07.08.2025, one Pitchaiammal, lodged a complaint before the respondent police stating that she and her family members are residing in the farm house situated at Maniyankurichi inter section, Trichy District. On 06.08.2025 at about 10.00 P.M. she and her family members went to bed. At about 10.45 P.M, 5 unknown persons barged into her house and robbed 91⁄2 sovereigns of gold jewels and cash of Rs.1,00,000/-from her house. The investigation revealed that the petitioner and 4 others indulged in such act. Hence, a case has been registered.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the 2/5

prosecution. However, he has been arrested and he is languishing in jail from 11.08.2025. Therefore, he prays for grant of bail.

4. The learned Additional Public Prosecutor appearing for the respondent police opposed for grant of bail on the ground that the investigation is still pending.

5. It is seen the respondent had detained the petitioner under Act 14, subsequently the same was revoked. The 1st bail application was dismissed since the petitioner was detained under Act. 14. Now it is second bail application. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner and the investigation is still pending, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 19.11.2025 TMG 3/5
