ORDER
The petitioner seek to quash the impugned charge sheet in C.C.No. 59 of 2017 pending on the file of the learned Judicial Magistrate No.2, Ramanathapuram, which was filed for the offences under Sections 465, 468 and 471 of IPC.
2.When this Court expressed that the points raised by the learned counsel for the petitioner are factual in nature, the learned counsel for the petitioner sought permission of this Court to withdraw this criminal original petition and has made an endorsement to that effect. However, the learned counsel for the petitioner would submit that since the petitioner is aged about 60 years and has been facing trial since 2017, the learned magistrate may be directed to expedite the trial and the petitioner's personal appearance before the trial Court may be dispensed with.
3.In view of the above submission, this Criminal Original Petition is dismissed as withdrawn. However, the learned Judicial 2/4
Magistrate No.2, Ramanathapuram, is directed to expedite the trial in C.C.No.59 of 2017 and conclude the same within a period of six months from the date of receipt of a copy of this order. The personal appearance of the petitioner before the Trial Court is dispensed with on all hearing dates (provided he is represented by a lawyer) unless his appearance is required by the learned Magistrate for the progress of the trial.
