ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/4

for the offences punishable under Sections 318(4), 336(2), 336(3) of BNS, 2023 in Crime No.58 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the De-facto complainant is working as a Manager in the Sumathi Dental Hospital, Anna Nagar and the accused no.1 is working as Supervisor in the same hospital. The accused No.1 misappropriated the management amount of Rs.40,00,000/- during her work at the hospital. Hence, a case has been registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. 5.The petitioner is the brother of A1, who has received cash and purchased the lorries. Even though the same is an allegation, the petitioner submits that he obtained a loan from the bank and is paying EMI regularly. The 2/4

petitioner relied on his bank statement. But the allegation is only regarding the cash transaction. Therefore, it will not reflect in the bank. Therefore, the said submission cannot be entertained.

6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 19.02.2026 TMG TO 1.The Inspector of Police, CCB Police Station, Madurai City, Madurai District.
