ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 3 and 4 to conduct survey as per Tamil Nadu Survey and Boundaries Act, 1923 and to fix boundaries in respect of land, measuring an extent of 14 cents comprised in the northern side of 42 cents in Survey No.208/1, situated at Kovilankulam Village, Usilampatti Taluk, Madurai District and to direct the respondents 5 and 6 to give police protection while surveying the above said land, by considering the petitioner's complaint dated 03.08.2025, within a time frame fixed by this Court.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, he is the owner of land measuring 14 cents, forming the northern portion of 42 cents in Survey No.208/1, situated at Kovilankulam Village, Usilampatti Taluk, Madurai District. The petitioner

submitted several representations requesting the official respondents to conduct a proper survey and fixation of boundaries in accordance with the Tamil Nadu Survey and Boundaries Act, 1923. In view of possible obstruction / interference during the survey, the petitioner has requested the respondents 5 and 6 to provide police protection while carrying out the survey.

Despite the submission of the representations and the complaint, no action has been taken by the official respondents to survey or demarcate the property, causing hardship to the petitioner and affecting peaceful enjoyment of his land. Therefore, the petitioner has approached this Court for the relief stated supra.

5. The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that after consideration of the claims of both parties, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the third respondent to consider the representation of the petitioner dated 10.04.2024 and demarcate the land of the petitioner, after consideration of the claims of both the parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
